Terms of Service

These terms describe, in plain language, how Envoi operates and the rules for using the Service. Questions? Email support@envoi.email.

1. Overview

These Terms of Service ("Terms") govern your access to and use of Envoi, an email and SMS marketing platform that provides campaign creation, an AI-assisted email editor, contact and audience management, automations, a unified inbox, deliverability tooling, and analytics ("the Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and any organization you represent.

2. Accounts and eligibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Keep your account information accurate, and restrict access to authorized members of your team. Notify us promptly if you believe your account has been accessed without authorization.

3. Billing and subscriptions

Paid plans are billed through Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method on the billing cycle shown at checkout. Envoi does not store full card numbers; card data is handled by Stripe.

Fees are charged in advance and, except where required by law, are non-refundable for the period already billed. We may change pricing with reasonable advance notice; changes take effect at your next renewal.

4. Acceptable use and messaging compliance

You may only send messages to recipients who have given you permission to contact them, and you must honor unsubscribe and preference requests promptly. You are responsible for complying with the laws that apply to your messaging, including anti-spam laws (such as CAN-SPAM and CASL), the TCPA, and carrier requirements for SMS.

SMS senders must complete carrier registration (A2P 10DLC) where required and may only send message categories that match their approved campaign. You may not use the Service to send unlawful, deceptive, hateful, or abusive content, to distribute malware, or to harvest or purchase contact lists without consent.

5. Your content and contact data

You retain ownership of the content you create and the subscriber and contact data you import or collect through the Service. As between you and Envoi, your subscribers’ data belongs to you. You grant us the limited rights needed to host, process, transmit, and display that data solely to operate and improve the Service for you.

You are the controller of your contact data and are responsible for having a lawful basis to collect and message those contacts. We act as your processor for that data and handle it according to our Privacy Policy.

6. Tracking and analytics

The Service can embed open-tracking pixels and rewrite links for click tracking so you can measure campaign performance. You are responsible for disclosing this tracking to your recipients where the law requires it. Aggregated, non-identifying performance data may be used to operate and improve the Service.

7. Third-party subprocessors

We rely on reputable infrastructure and messaging providers to deliver the Service. These subprocessors may process your data to perform their functions:

  • Stripe — subscription billing and payment processing.
  • Resend — outbound email delivery.
  • Telnyx and Twilio — SMS delivery and phone number provisioning.
  • Vercel and Fly.io — application hosting and compute.
  • Neon — the managed PostgreSQL database.
  • Backblaze — object storage for uploaded media and assets.

8. Service availability

We work to keep the Service available and reliable, but it is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features, and we perform maintenance that can cause temporary interruptions. We do not guarantee that every message will be delivered, as delivery depends on recipients, mailbox providers, and carriers outside our control.

9. Cancellation and termination

You may cancel your subscription at any time from your billing settings; cancellation stops future renewals and takes effect at the end of the current billing period. You may request deletion of your account and data as described in our Privacy Policy. We may suspend or terminate accounts that violate these Terms or that create risk for recipients, carriers, or the Service.

10. Limitation of liability

To the maximum extent permitted by law, Envoi is not liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

11. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
